Terms & Conditions

1. Scope

These Terms & Conditions govern the use of MSK Forms, a hosted form and application platform available at forms.msk-scripts.de, operated by Moritz Kohm ("we", "us", "MSK Scripts"). The service includes:

  • the web application for building forms, collecting submissions, and reviewing them;
  • the public form and status pages (under /f/… and /s/…);
  • the MSK Forms Discord bot, a multi-tenant bot you can invite to your Discord server (guild).

By logging in, inviting the bot to a server, building or sharing a form, or submitting a form, you agree to these terms.

2. The Service

MSK Forms lets a Discord server (guild) build forms, share them via a link, QR code, embed, or the bot, and review the resulting submissions. Applicants receive a private link on which they can track the status of their submission. Acceptance can grant a Discord role and notify the applicant by direct message.

We provide the platform; we do not author the forms or decide what data they collect — that is done by the guilds that use the service (see section 5).

3. Account and Eligibility

Access to the dashboard requires logging in with Discord (OAuth). You are responsible for the security of your Discord account and for all actions taken under it. You must comply with the Discord Terms of Service and Community Guidelines, and you must be old enough to use Discord in your jurisdiction.

A guild is linked to MSK Forms when the bot is added to it; the guild owner becomes the owner in MSK Forms and can grant roles to other members.

4. Acceptable Use

You agree not to use MSK Forms to:

  • create forms or collect data that violate applicable law, the rights of third parties, or the Discord Terms of Service;
  • collect personal data without a valid legal basis or without informing the people you collect it from;
  • send spam or unsolicited messages, or otherwise abuse Discord's infrastructure;
  • upload or distribute malware, illegal content, or content that infringes third-party rights;
  • attempt to disrupt, overload, reverse engineer, or circumvent the security of the service (including rate limits and captcha);
  • resell or sublicense the service without our written consent.

We may suspend or terminate access, remove the bot from a server, or delete content that violates these terms, applicable law, or Discord's policies — where reasonable, with prior notice.

5. Responsibility of Guild Operators

If you create forms on a server, you decide which questions to ask and what data to collect. With respect to the personal data of your applicants, you are the responsible party (controller) for that processing. In particular, you are responsible for:

  • having a valid legal basis to collect and process the data you request;
  • informing your applicants about how their data is processed (e.g. in your own privacy notice) and that a third-party service (MSK Scripts) operates the platform on your behalf;
  • the legality and content of the forms you publish and the way you use the submissions you receive;
  • responding to data-subject requests relating to the applications you collect.

MSK Scripts processes that data on your behalf as part of providing the platform. See our Privacy Policy for details on the respective roles.

6. Plans, Subscriptions and Billing

MSK Forms offers a Free plan and paid Pro and Enterprise plans. Plans, prices, and the limits that apply to each (number of forms, submissions per month, team members, and feature availability) are shown on the pricing page. A subscription applies per Discord server; each server is upgraded independently.

  • Payment is processed by Stripe (Stripe Payments Europe, Ltd.). We never receive or store your card details. By subscribing, you also agree to Stripe's terms.
  • Subscriptions are billed monthly and renew automatically until cancelled.
  • You can cancel at any time via the Manage subscription button (Stripe customer portal). On cancellation, the plan remains active until the end of the current billing period, after which the server is downgraded to Free. Plan-specific features (e.g. custom domain, automations, API access) are deactivated on downgrade.
  • No partial refunds are provided for unused subscription time, except where required by mandatory law.
  • We may change plans, prices, or limits going forward; material changes will be announced with reasonable notice and apply from the next billing period.

Right of withdrawal (consumers)

If you are a consumer in the EU, you have a statutory right of withdrawal for paid subscriptions. By starting a paid subscription and requesting that the service begin immediately, you agree that performance begins before the withdrawal period expires; the statutory right of withdrawal expires once the service has been fully provided.

7. Custom Domains (Pro and above)

Paid plans may configure a custom domain for their public forms.

  • You must own and control the domain you configure and set the required DNS records.
  • An SSL certificate is obtained automatically (Let's Encrypt) at no additional cost. Your domain name may appear in public Certificate Transparency logs as a result.
  • We may remove custom domains that are misconfigured, cause conflicts, or violate applicable law.
  • On cancellation or downgrade to Free, the custom domain is deactivated.

8. Service Availability

We strive for high availability but do not provide a guaranteed uptime or SLA. The service may be temporarily interrupted for maintenance, updates, or reasons beyond our control. We accept no liability for submissions, status updates, role grants, or notifications that are delayed or lost due to downtime, Discord outages, or discontinuation of the service.

9. Data, Deletion and Termination

  • Applicants can withdraw, export, or delete their own submission from their status page, using only the submission link (no login).
  • Deleting a form removes its submissions and any uploaded files. Removing the bot from a server, or deleting your data via the dashboard, removes the associated data as described in our Privacy Policy.
  • Either party may terminate the use of the service at any time. We may delete data associated with a server after the bot is removed and the subscription has ended.

10. Intellectual Property

The MSK Forms platform, software, design, and brand are the intellectual property of MSK Scripts. These terms grant you a non-exclusive, non-transferable right to use the service as provided. The content of your forms and the submissions you collect remain yours; you grant us only the rights necessary to host, process, and display them in order to provide the service.

11. Limitation of Liability

To the extent permitted by law, MSK Scripts accepts no liability for damages arising from the use of the service, except in cases of intent or gross negligence, or for injury to life, body, or health, or where liability is mandatory by law. In particular, we accept no liability for:

  • temporary unavailability of the service;
  • loss of data beyond the stated retention or due to user action;
  • changes to Discord, Stripe, Cloudflare, or other third-party platforms affecting functionality;
  • the content of forms and submissions created by users of the service;
  • domain-related issues arising from DNS misconfiguration by the user.

12. Support

Support is provided via our Discord server. We aim to respond promptly but cannot guarantee specific response times.

13. Changes to These Terms

We may update these Terms & Conditions to reflect changes to the service or applicable law. Changes are published on this page with an updated date. Continued use of the service after changes are published constitutes acceptance of the updated terms. For material changes, we will make reasonable efforts to notify affected users in advance.

14. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. To the extent permitted by law, the exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is the operator's place of business.
